## How it works

## Questions

### What is an initial escrow account statement?

It is the first accounting the servicer gives the borrower for the escrow account. Under 12 CFR 1024.17 it is due at settlement or within 45 calendar days of settlement, it itemises the taxes, insurance premiums and other charges expected from the account in the coming computation year, and it names the cushion the servicer selected.

### How large a cushion is allowed?

No greater than one sixth of the estimated total annual disbursements from the account, which works out at about two months of escrow payments. If state law or the loan documents set a lower limit, the lower limit applies, and the rule never requires a cushion at all.

### What happens when the analysis shows a surplus?

If the borrower is current and the surplus is 50 dollars or more, the servicer refunds it within 30 days of the analysis. Under 50 dollars it can be refunded or credited against the next year of escrow payments.

### Does this replace our trust accounting package?

No. It sits beside it. The accounting package stays the book of record for the money. This holds the file, the parties, the payoffs, the statement clock and who released each disbursement, which is the part that gets rebuilt from email today.

### Can it hold wire instructions?

Yes, attached to the party they belong to, with the verification that was done and the person who did it. The point is not storage, it is that the instruction and its verification stop living in separate places.
