Why it stays broken
An independent ATM operator is a cash business that depends on a bank account, and the bank is reading a rulebook the operator never sees. FinCEN had to publish a statement telling banks that ATM operators are not automatically higher risk, precisely because so many were losing their accounts. Meanwhile the route itself is run from a phone, the vault count is on paper, and the settlement report arrives from the processor the next morning. Nothing joins the three together.
FinCEN notes that an operator replenishing machines solely with cash withdrawn from its own bank account may pose lower risk, because the bank can see the source of funds.
An independent ATM operator is an individual or an entity that is in the business of owning, leasing, managing, or otherwise controlling access to the interior of an ATM, including its internal cash vault.
