Why it stays broken
Scheduling software treats a flagger as a name in a shift slot. The MUTCD treats a flagger as a position, a paddle size, a pole height and a garment class. Those are different things, and no crew calendar records the second one. So the compliance evidence a contractor needs after an incident was never captured while the work was going well.

The long duration shift
A lane closure that was meant to last ten minutes runs for two hours. The MUTCD guidance points to a 7 foot pole for mounting the paddle once control extends beyond a few minutes, and nobody brought one. Recording the expected duration at scheduling makes that a packing decision rather than a discovery.
The vest that failed
An inspector questions a garment. Flagger vests must meet the MUTCD and ANSI 107-2015 colour requirements. Knowing which vests were issued, when, and against which standard turns a dispute into a lookup.
Emergency traffic control
An oversize move stops on a shoulder. Many states require a 24 inch red flag for emergency control when no paddle is available, plus warning devices at set distances. The kit carried should be recorded before the trip, not recalled after it.

Is the MUTCD actually law?
Yes, by incorporation. The FHWA has incorporated the Manual on Uniform Traffic Control Devices by reference at 23 CFR 655.601, which is what turns its guidance into an enforceable federal requirement rather than advice. State specifications then layer their own contract terms on top, which is why a flagging operation can be answerable to a federal manual and a state section at the same time.
How does this help after an incident?
Incident investigations ask physical questions: where was the flagger standing, what were they holding, how tall was the pole, what class of vest, how far back was the warning device. If those were recorded at the shift they are answered in minutes. If not, the answer is whatever people remember.

Why we are building this
What drew us to this was how measurable the requirements are. A paddle is a size. A pole is a height. A vest is a standard with a number on it.
Those are exactly the things software is good at holding, and exactly the things that end up undocumented because the crew calendar only knows names and times. After an incident that gap becomes the whole story.
So we are building the shift record around the physical specification rather than the roster. The Neurobird Team is starting with a small number of contractors who can tell us when we get it wrong.
