The estate administrator handles all of these steps under court supervision and must document every action on the docket sheet.

When must the estate inventory be filed?

State statutes set the deadline for filing the estate inventory with the probate court. In most jurisdictions the inventory must be filed within 90 days of the estate administrator's appointment. The inventory lists all property and debts of the decedent with values determined at the time of death. Missing this deadline can result in court sanctions against the administrator.

What tax returns does an estate administrator need to file?

The estate administrator must file the decedent's final individual income tax return on Form 1040 for the year of death and any prior unfiled years. The administrator must also file estate income tax returns on Form 1041 if estate assets generate more than $600 in annual income. A federal estate tax return on Form 706 is required for large estates exceeding the federal exemption threshold.

How are creditor claims handled during probate?

The estate administrator publishes a newspaper notice notifying creditors of the decedent's death. State statutes define a claim period, usually 30 to 90 days, during which creditors must file claims. The administrator then reviews each claim for validity and determines which claims to pay in whole or in part according to statutory priority rules. Untimely claims may be barred permanently.

What happens at the end of probate administration?

When all debts, expenses, and taxes have been paid, the estate administrator files a final accounting with the court. This accounting lists all property received, income earned, expenses paid, and the amount remaining for distribution. After the court approves the accounting, the administrator distributes assets to heirs and files an affidavit of closing. Any probate bond is then terminated by the court.
